By signing up to be an Affiliate for The Nutritious Life Studio (NLS), you agree to the following terms:

Affiliate Program, also referred to as Referral Program, Terms & Conditions for Nutritious Life

This agreement is by and between Keri Glassman, LLC (dba as Nutritious Life) and/or their assigns and all subscribers. Unless the context requires otherwise, Nutritious Life and/or their assigns shall be referred to as “us, we, or our” and you shall be referred to as “you, your or subscriber.” You understand that Nutritious Life and/or their assigns does not guarantee or predict any type of profit or response from said services. Subscriber agrees to hold Nutritious Life harmless from and against any and all losses, claims, expenses, suits, damages, costs, demands or liabilities, joint or several, of whatever kind or nature which Nutritious Life and/or their assigns may become subject arising out of or relating in any way to the use of the services provided under this agreement, including, without limitation, in each case attorneys’ fees, costs and expenses actually incurred in defending against or enforcing any such losses, claims, expenses, suits, damages or liabilities.

A. Services to be Provided. We agree to reward you as described on our website for referral sales made by customers: a $300 gift card for referrals who are new to our database and enroll in the Become a Nutrition Coach program; or 15% commission gift card for referrals who are new to our database and purchase our ebooks or courses, excluding the Become a Nutrition Coach program. Affiliates cannot earn commission on products purchased by themselves, or by other existing NLS students, alumni, affiliates, and ambassadors. Rates can be changed without notice due to abuse.

B. Termination. We may terminate your account: (a) if you violate our Terms Of Service Policy; (b) promote Nutritious Life in a manner that is unethical or inappropriate; or (c) for any reason, in our sole discretion. DO NOT SPAM ANYBODY FOR ANY REASON. This includes on Social Media services such as Facebook, Twitter, Pinterest, Instagram, LinkedIn, etc. You may post relevant content in social media, but you may NOT spam people via social media. Inappropriate use of social media will also be grounds for account termination without warning.

C. No Warranties. WE MAKE NO WARRANTIES TO YOU OF ANY KIND, EXPRESSED OR IMPLIED, WITH RESPECT TO THE SERVICE THAT NUTRITIOUS LIFE, ITS SUBCONTRACTORS AND AFFILIATES PROVIDE YOU. WE EXPRESSLY DISCLAIM ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS OF THIS SERVICE FOR A PARTICULAR PURPOSE. We shall not be liable for any damages suffered by you, whether indirect, special, incidental, exemplary, or consequential, including, by not limited to, loss of data or service interruptions, regardless of cause or fault. We are not responsible for your lost profits or for your loss of data or information.

D. Affiliates: All affiliate membership is subject to prior approval. Nutritious Life reserves the right to refuse service to any new or existing affiliate, in its sole discretion, with or without cause. Nutritious Life reserves the right to refuse to do business with anyone, at any time, for any reason. Nutritious Life reserves the right, without liability, to reject, omit or exclude any affiliate, webmaster or website for any reason at any time, with or without notice and regardless of any previous conditions. Each affiliate entity is only permitted 1 affiliate account. By using our Affiliate Program, You warrant that: * You are 18 years of age and that there is no legal reason that You cannot enter into a binding agreement. * You are the owner or are licensed to use the entire contents contained on Your website. * Your website and/or newsletter does not violate any law or regulation. * Your website and/or newsletter does not contain misrepresentation or content that is defamatory or violates any rights of privacy or publicity. * Your website and or/newsletter does not and will not infringe any copyright, trademark, patent or other proprietary right. * You may place our banners anywhere on your site as you see fit, or within non-spam emails. * NOT ALLOWED: All other uses of banners or links, such as newsgroups, chat rooms, message boards, banner networks, counters, or guestbooks etc. are NOT allowed. * Failure to abide by these rules could mean termination from Affiliate Program. * Fraud is a serious offense, and will be treated as such. Fraud is defined as any action that intentionally attempts to create sales or click-throughs using robots, scripts, or manually “refreshing” of pages, for the sole purpose of creating commissions.

E: Privacy policy: Nutritious Life respects the privacy of its users and promises not to disclose personal or business information to third parties without the express permission of You and Your company. We will not sell Your name, e-mail address, phone number, or any other personal information to anyone else. We consider this information to be private, and it will remain as such. F: Affiliate payment: Nutritious Life Affiliate Program is operated by Nutritious Life. Nutritious Life is responsible for reward distribution of affiliate earnings related to the Nutritious Life affiliate program. You will receive a reward for sending authorized sales via your links. You understand that the payout amount may be changed at any time. You are responsible for determining if the payout for a link You have placed on Your site has changed or been discontinued. You receive the reward from Nutritious Life. Once rewards are earned You’ll get a request to confirm your country of residence, and then you will receive an email with your rewards pertaining to the Referral Program you earned a reward for.

For the Become a Nutrition Coach Referral Program: You will receive a $300USD (or equivalent, based on your country’s currency) gift card reward where you can choose a gift card from the menu of approved brands within your country.

For the Nutritious Life Products Referral Program: You will receive a gift card reward equivalent to 15% of the amount your referral spent (or equivalent, based on your country’s currency) on Nutritious Life products including ebooks and courses and excluding the Become a Nutrition Coach program, where you can choose a gift card from the menu of approved brands within your country.

For all Referral Programs: Your reward will be awarded to you between 15-30 days after the refund period has passed for the person who purchased or enrolled using your unique link. You understand your gift card has an expiration date, and Nutritious Life cannot reissue you a new gift card after the expiration period has passed. You agree to forfeit any unused gift cards that expired. You are solely responsible for all tax obligations due to all taxing authorities arising from or in connection with your participation in our Referral Programs. Nutritious Life shall not withhold any taxes of any kind from your reward.

G: Refunds, Chargebacks and Bad Checks: If an order is later refunded to the customer or charged back by the customer, or if a customer’s check does not clear, the referral reward, and any Affiliate charge back fees, will be deducted from the earned reward.
